Highways must be kept clear of obstructions for safety reasons.  The local authority has the power to serve notice on a person who commits an offence of willful obstruction on the highway. If no action is taken by the offender then we will involve Legal Services and issue a notice or remove the obstruction and recharge the offender the costs. This action would be taken as the Council is the Highway Authority
and has powers under the Highways Act 1980 to carry this out.. In certain circumstances the courts allow the highway authority to remove obstructions to the highway.
